THESE TERMS AND CONDITIONS FORM YOUR AGREEMENT IN RELATION TO YOUR SCARBOROUGH SPA GIFT VOUCHER.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE YOU USE YOUR VOUCHER.

IF THERE IS ANYTHING YOU DO NOT UNDERSTAND OR DO NOT AGREE WITH, PLEASE CONTACT CUSTOMER SERVICES USING THE CONTACT DETAILS AT CLAUSE 13.1 OF THIS AGREEMENT.

 

1. ABOUT YOUR VOUCHER

1.1          Your Voucher is issued by SIV Enterprises Ltd a company registered in England and Wales (company number 6385377) whose registered office is at Riverside East, 2 Millsands, Sheffield, S3 8DT (“SEL”).

1.2          The Voucher contains the monetary value which was paid, in advance, at the point of purchase.

1.3          Your Voucher is valid for 12 months from the date of purchase.

1.4          It is non-refundable and non-returnable, except in accordance with your legal rights, for example in accordance with clause 5. Refunds can only be made to the purchaser of the Voucher.

1.5          Your Voucher has no cash redemption value and cannot be exchanged for cash.

 

2. VOUCHER PURCHASE AND ACTIVATION

2.1          You can purchase a Voucher from SEL by telephone on 01723 821888, online at www.scarboroughspa.co.uk, or in person at the Scarborough Spa Box Office.

2.2          Your Voucher will be valid and ready to use at the point of purchase.

 

3. WHAT CAN YOU BUY WITH YOUR VOUCHER?

3.1          The Voucher can only be used to buy tickets to participating events held at Scarborough Spa.

3.2          You cannot use your Voucher to buy ticket insurance or to redeem any goods or services other than Scarborough Spa Tickets.

 

4. WHERE CAN YOU USE YOUR VOUCHER?

4.1          Your Voucher can be redeemed in part or in full in person at the Scarborough Spa Box Office, by telephone on 01723 821888, or online at www.scarboroughspa.co.uk (when available).

4.2          You cannot redeem your Voucher on any websites other than www.scarboroughspa.co.uk, even if they are websites which are linked to, or referenced on www.scarboroughspa.co.uk.

4.3          A payment for Scarborough Spa Tickets can be made partly using the Voucher and partly by other accepted payment methods (for example, credit or debit cards).

4.4          When using your Voucher for online or telephone transactions you will need the redemption number written on the Voucher in order to complete the transaction.

 

5. CONSUMER RIGHTS

5.1          If you have purchased your Voucher online and are contracting as a consumer the following consumer rights apply.

5.2          You can cancel your Voucher purchase and receive a full refund of the price paid for a period of fourteen (14) days from the date of delivery of the Voucher. SEL will also refund any delivery charges. However, you will be responsible for the cost of returning the Voucher to SEL, if we request it.

5.3          To cancel your Voucher purchase, please (a) contact customer services on 01723 821888; or (b) contact us by emailing SpaBoxOffice@sivltd.com. You will need to quote the redemption number for the Voucher, which can be found written on the Voucher.

 

6. VOUCHER EXPIRY

6.1          You have right to redeem your Voucher for Scarborough Spa Tickets for a period of 12 months from the date of purchase.

6.2          You will not be able to use your Voucher once it has expired or claim a refund of any unused funds.

 

7. VOUCHER SECURITY

7.1          You should treat the Voucher as if it were cash. If you lose your Voucher you may lose the value of it in just the same way as if you lost cash.

7.2          Your Voucher redemption number should be kept secret at all times and should not be disclosed to anyone other than to Scarborough Spa Box Office staff

7.3          If you lose your voucher, the voucher remains unused, you are able to prove purchase and have retained your Voucher redemption number then SEL may be able to replace the voucher upon payment of a £5 administration fee.

 

8. RIGHT TO TERMINATE, CANCEL OR REFUSE A TRANSACTION

8.1          SEL may terminate this agreement, cancel your Voucher, or refuse a transaction if we suspect the Voucher is being used fraudulently, or in an unauthorised or illegal manner, or if we have reason to believe that you are in breach of this agreement.

8.2          If we need to investigate a transaction using the Voucher then you must cooperate with us, the Police or any other authorised body if this is required.

8.3          SEL can terminate this agreement and refund any unused funds to you at any time if we give you 30 days' notice.

 

9. YOUR PERSONAL DATA

9.1          Any personal data which you may from time to time provide in connection with your Voucher shall be processed in accordance with SEL’s Privacy Policy which can be viewed online at http://www.scarboroughspa.co.uk/privacy.

 

10. LIMITATION OF LIABILITY

10.1       SEL will not accept liability for Vouchers which are lost, stolen, destroyed or used without permission, unless SEL has caused this by its negligence.

10.2       SEL shall not be liable for loss of business, use, profit, anticipated profit, contracts, revenues, goodwill or anticipated savings; loss of data or use of data; or consequential, special or indirect loss or damage; even if it has been advised of the possibility of such loss or damage.

10.3       Subject to the terms and conditions of this agreement, SEL shall have no liability to you beyond the amount of unused funds which remain on the Voucher on the earlier of the date on which: (a) the Voucher is cancelled by SEL; or (b) this agreement is terminated by SEL; or (c) the Voucher expires.

10.4       Nothing in this agreement seeks to exclude or limit any liability for: (a) death or personal injury caused by negligence; (b) fraudulent misrepresentation; or (c) any other type of liability which cannot by law be excluded or limited.

 

11. VARIATION

SEL may change the terms and conditions of this agreement at any time by posting an amended version on www.scarboroughspa.co.uk for one or more of the following reasons:

(a)           to reflect the introduction or development of new systems, methods of operation, services or facilities;

(b)          to reflect a change or an expected change in market conditions, general good practice or the cost of providing services to our customers;

(c)           to conform with or anticipate any changes in the law or taxation, any codes of practice or recommendations of the Financial Services Authority or other regulatory body;

(d)          to ensure that our business is run prudently and remains competitive;

(e)          to take account of a ruling by a court, ombudsman, regulator or similar body having legal or commercial jurisdiction over SEL;

(f)            to make the terms and conditions of this agreement fairer or clearer for you;

(g)          to rectify any mistake that might be discovered in due course; or

(h)          by agreement with you.

 

12. GENERAL

12.1       Any delay or failure to exercise any right or remedy under this agreement by SEL shall not be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.

12.2       If any provision of this agreement is deemed unenforceable or illegal, the remaining provisions will continue in full force and effect.

12.3       We may assign our rights and benefits at any time without prior written notice to you. We may subcontract any of our obligations under this agreement.

12.4       No third party who is not a party to this agreement has a right to enforce any of the provisions of this agreement.

12.5       This agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law. You irrevocably agree to submit to the non-exclusive jurisdiction of the courts of England in relation to any claim or matter arising out of or in connection with this agreement (including non-contractual disputes or claims).
